1. Acceptance of Terms
By using the Chive app (including our website at chive-app.com), you agree to follow these terms. If you don't agree with any part of these terms, please don't use Chive.
We may update these terms from time to time. We'll notify you of material changes through the app or email. Your continued use means you accept the updated terms.
2. Account Registration and Responsibilities
To use Chive, you need to create an account. You're responsible for:
- Keeping your password confidential
- All activity that happens under your account
- Notifying us immediately if you suspect unauthorized access
- Providing accurate information when you sign up
You must be at least 13 years old to use Chive. If you are under 18, you represent that you have your parent or guardian's permission to use the app.
3. Pricing and Future Premium Features
Chive is currently free to use. We may introduce premium features (Chive+) in the future. If we do, we will provide at least 30 days' notice before any features move behind a paywall, and existing free functionality will remain available.
4. User Content and Data Ownership
Your Data Ownership
You own all the information you add to Chive, including inventory items, grocery lists, notes, purchase history, photos, and recipes.
License to Chive
You grant Chive a limited license to store, process, and display your data within the app, back up your data for recovery and security, and analyze de-identified, aggregated data to improve the app.
Restrictions
Chive will not:
- Use your personal data to train AI models
- Sell or rent your data to third parties
- Use your data for marketing or targeted advertising
Data Deletion
When you delete your account:
- Your data is removed from our primary servers immediately upon request
- Backup copies may be retained for an additional 30 days before automatic deletion
- Aggregated, de-identified analytics may be retained indefinitely
5. Household Sharing
Chive allows you to share a household with other users. When you join or create a household:
- All household members can view and edit the shared pantry inventory, shopping list, purchase history, and recipes
- The household owner controls membership and can invite or remove members at any time
- You can leave a household at any time through app settings
- Data you add to a shared household is visible to all members of that household
You are responsible for only inviting people you trust to your household. Chive is not responsible for how other household members use shared data.
6. Acceptable Use
You agree not to use Chive for illegal purposes, upload malware, attempt to hack our systems, or reverse engineer our source code.
7. AI Assistant, Food Safety, and Health Disclaimers
AI Assistant
The Chive AI assistant is provided for informational and convenience purposes only. It is not a substitute for professional medical, dietary, nutritional, or health advice. The AI may make mistakes. You are solely responsible for verifying any information it provides.
AI Data Processing
When you use AI-powered features (chat assistant, receipt scanning, food photo identification, cookbook scanning), relevant data from your account, including inventory items, shopping list, purchase history, recipes, and your messages, is sent to Anthropic (the maker of Claude AI) for processing. Anthropic does not use your data to train AI models. See Anthropic's privacy policy for details on their data handling practices.
Product Information and Accuracy
Product information displayed in Chive, including names, categories, nutrition facts, allergen data, images, and prices, is sourced from third-party databases and retailer APIs. This information may be inaccurate, incomplete, or outdated. Chive does not endorse or guarantee the accuracy or reliability of any third-party product data, including expiration dates, allergen information, ingredient lists, or pricing.
Allergens and Dietary Information
Allergen and dietary information in Chive is sourced from third-party databases and may be incomplete or inaccurate. Never rely on Chive for food allergy management or food safety decisions. Always check the actual product packaging for allergen and ingredient information. Chive does not track cross-contamination risks. Users with food allergies or dietary restrictions should always verify information directly on the physical product.
Expiry Date Estimates
Expiry dates shown in Chive are estimates based on product type, storage zone, and general food safety guidelines (including USDA FoodKeeper data). These are general guidance only and are not a guarantee of food safety. Always check the actual expiry date on the product itself and use your own judgment about whether food is safe to consume.
Not Medical or Nutritional Advice
Chive is not a medical professional, nutritionist, dietician, or food safety authority. Nothing in this app should be considered medical, dietary, or nutritional advice. If you have health concerns related to food, consult a qualified healthcare provider.
8. Third-Party Services
Chive uses the following third-party services:
- Anthropic (Claude AI): Powers the AI assistant, receipt parsing, food photo identification, and cookbook scanning. Anthropic does not use your data to train AI models. See Anthropic's privacy policy.
- Supabase: Cloud database and file storage
- Product data APIs: Open Food Facts, UPC Item DB, and select Canadian retailer APIs (Loblaw, Metro, Food Basics, LCBO, Flipp, Voila) to enrich product information. Only product names and barcodes are sent to these services. No personal data.
You can manually import Instacart order data by pasting order text into Chive. We do not have an API partnership with Instacart.
9. Intellectual Property
Chive's name, logo, design, features, and code are our intellectual property. The content you create (your inventory, lists, photos) is yours to keep.
10. Limitation of Liability
THE CHIVE APP AND ALL RELATED SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CHIVE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE APP.
TO THE EXTENT PERMITTED BY ONTARIO LAW, CHIVE'S TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID IN THE PRECEDING 12 MONTHS OR $100 CAD.
11. Indemnification
You agree to indemnify, defend, and hold harmless Chive and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to your use of the app, your violation of these Terms, or your violation of any rights of a third party.
12. Account Deletion
You can delete your account at any time through app settings. Upon deletion:
- Your data will be removed from primary servers immediately
- Backup copies retained for up to 30 additional days before automatic deletion
- Before deleting, you can export your data (inventory, grocery list, purchase history) in CSV or JSON format through app settings
13. Dispute Resolution
Before filing any formal claim or proceeding, you agree to contact us at [email protected] and allow 30 days for informal resolution. Most disputes can be resolved without formal proceedings.
14. Privacy
Your use of Chive is also governed by our Privacy Policy.
15. Governing Law
These Terms are governed by the laws of the Province of Ontario and the laws of Canada. Any dispute will be resolved in the courts of Ontario.
